Writs

A writ is a formal written order issued by  a judicial or administrative authority to  enforce legal rights or resolve disputes.

They are legal remedies for protecting  the rights of individuals.

Constitution of India empowers both  the Supreme Court and High Courts  to issue writs.

Supreme Court can issue  the writs under Article 32.

High Court can issue the writs under Article 226.

We adopted this concept from English law  where it was known as ‘Prerogative writs’.

Parliament can empower any court to  issue the writs.

Before 1950, only High courts of Calcutta,  Bombay and Mudras had the powers to  issue writs

Now all High Courts can issue  the writs under article  226.
